Consumer Need Not Prove the Debt is Invalid

Post by David A. Szwak »

The consumer need not prove the debt is invalid, although payment of amounts not owed as a result of an FDCPA violation would certainly constitute actual damages. Baker v. G.C. Services Corp., supra, 677 F.2d 775 (9th Cir. 1982); McCartney v. First City Bank, supra, 970 F.2d 45 (5th Cir. 1992). But, see: Johnson v. Eaton, 80 F.3d 148 (5th Cir. 1996).
