[4] The defendants argue they are entitled to summary judgment on this claim because they had no knowledge about the nature and extent of the plaintiff's disability and the plaintiff did not reveal the nature or extent of his disability during the collection calls. The defendants deny knowing any information “that allowed them to gain an advantage over Caputo or enabled them to make a misleading statement of opinion that they knew Caputo was likely to rely upon.â€
