*1 On or around October 13, 2006, Defendant served upon Plaintiff an offer of judgment pursuant to Fed.R.Civ.P. 68, under which Defendant agreed to “allow a judgment to be taken against this Defendant for the sum of $1,000.00, plus the court costs of this action, and reasonable attorney fees incurred up to the date [of] the filing of the within Offer of Judgment.â€
