Prevention of Abuse, Deception and Unfair Acts

Post by David A. Szwak »

The FDCPA protects consumers from abusive, deceptive and unfair debt collection practices and ensures that non-abusive debt collectors will not face a competitive disadvantage. 15 U.S.C. § 1692; United States v. Natl Fin. Servs. Inc., 98 F.3d 131, 135 (4th Cir.1996). The FDCPA entitles a successful plaintiff to an award of actual damages, to a statutory award of up to $1000, and to costs and reasonable attorney's fees. § 1692k(a).

McHugh v. Check Investors, Inc
Not Reported in F.Supp.2d, 2003 WL 21283288
