Tort Obligation is Not a "Debt"

This folder examines the definition of "debt" under the FDCPA. Whether a "debt" is the subject matter will determine whether the FDCPA applies. Case law and the definition under the FDCPA differentiate consumer debt from business-related debt.

Tort claims arising from the illegal reception of microwave telephone signals are also not within the definition of "debt". Zimmerman v. H.B.O. Affiliated Group, 834 F.2d 1163 (3d Cir. 1987). Tort obligations are not debts within FDCPA coverage. Hawthorne v. Mac Adjustment, 140 F.3d 1367 (11th Cir. 1998).
