Who Can the Collector Call For Location Info?

Post by David A. Szwak »

The debt collector may not communicate with someone other than the consumer except to obtain location information. 15 U.S.C. 1692b. Henderson v. Eaton, 2001 U.S.Dist.LEXIS 13243 (U.S.D.C. E.D. La. 2001) (Debt collector’s Rule 12(b)(6) motion to dismiss was denied where defendant’s letters to the consumer’s employer requested confirmation of her employment, her wage scale, type of employment, and the full name of her employer if she had been terminated because the letters were adequately alleged to be a communication indirectly conveying information about a debt.); United States v. Central Adjustment Bureau, Inc., 667 F.Supp. 370 (U.S.D.C. N.D. Tex. 1986), aff’d, 823 F.2d 880 (5th Cir. 1987).
