Although state law required the sending of a three day notice for back rent, the Second Circuit held that the attorney sending the letter violated the FDCPA. Romea v. Heiberger & Associates, 163 F.3d 111 (2d Cir. 1998). See: Sprouse v. City Credits Co., 126 F.Supp.2d 1083 (U.S.D.C. S.D. Ohio 2000) (validation notice which accompanies complaint). The Court of Appeals of Indiana held that it is the debt collector's duty under the FDCPA to obtain a hearing date outside the thirty-day debt validation period so as not to undercut the consumer's validation rights. Spears v. Brennan, 745 N.E.2d 862 (Ind.App. 2d Dist. 2001). A voluntary acceptance letter pursuant to Nebraska statute did not violate the FDCPA. Peters v. General Service Bureau, Inc., 2002 U.S. App. LEXIS 1103 (8th Cir. 2002).
