140 F.Supp.2d 1019, D.Minn., April 23, 2001

Husband and wife mistakenly pursued by debt collector sued for various torts. On collector's motion for summary judgment, the District Court, Doty, J., held that: (1) collector did not defame plaintiffs absent evidence that it made any statements, in investigatory calls to friends and neighbors, which lowered their opinions of plaintiffs; (2) collector's contact of only four neighbors or relatives and one employer of alleged debtors was insufficient to satisfy publicity requirement of tort of invasion of privacy by publication of private facts; and (3) collector's conduct was not sufficiently offensive to support tort claim for intrusion upon seclusion.
Motion granted.
