Bankruptcy courts are allowed to award consequential damages for emotional distress for underlying causes of action. See Maxwell v. Fairbanks Capital Corporation (In re Maxwell), 281 B.R. 101 (Bankr.D.Mass.2002)(violation of any provision of the FDCPA entitles the consumer to an award of actual damages which may include compensation for emotional distress); Fleet Mortg. Group, Inc. v. Kaneb (In re Kaneb), 196 F.3d 265 (1st Cir.1999)(emotional distress damages qualify as actual damages under 11 U.S.C. § 362(h)); In re Barry, 330 B.R. 28 (Bankr.D.Mass.2005)(allowed to include damages for emotional distress when a bankruptcy discharge is violated); Johnstone v. Bank of America, N.A., 173, F.Supp.2d 809, 815 (N.D.Ill.2001)(allowed to recover for actual damages for emotional distress caused by violations of RESPA).
