Siding company sued consumers for breach of contract. Consumer brought third-party demand against company's attorney for violating Fair Debt Collection Practices Act (FDCPA). After attorney stipulated to liability under FDCPA, the Nineteenth Judicial District Court, Parish of East Baton Rouge, No. 364,919, Joseph F. Keogh, J., awarded damages to consumers. Attorney appealed. The Court of Appeal, Fogg, J., held that: (1) trial court abused its discretion in awarding damages; (2) evidence supported finding that consumer endured physical depression as result of receiving threatening letter from attorney; (3) attorney fee award was proper; and (4) legal interest on attorney fees could not be awarded to consumers.
Reversed in part and amended in part, and affirmed as amended.
