15 USC 1692c[c]: Cease and Desist

Post by David A. Szwak »

Under the provisions of § 1692c(c) the debtor has an absolute right to require a collector to cease all future communications. In order to be effective, the debtor must notify the collector that they wish them to cease future communication in writing. This notification is effective upon receipt by the debt collector. After receiving such a notice the collector may only communicate with a debtor to notify him or her that collection efforts are being terminated or that the collector is going to invoke a specified remedy ordinarily invoked by the creditor or collector.
