Green Tree Fin. Corp.-Ala. v. Randolph

Post by David A. Szwak »

In light of the federal policy favoring arbitration, a party seeking to invalidate an arbitration agreement must establish that the agreement precludes them from effectively vindicating their statutory claim in the arbitral forum.

Green Tree Fin. Corp.-Ala. v. Randolph, 531 U.S. 79, 90, 121 S.Ct. 513, 148 L.Ed.2d 373 (2000).
