This folder examines the definition of "debt" under the FDCPA. Whether a "debt" is the subject matter will determine whether the FDCPA applies. Case law and the definition under the FDCPA differentiate consumer debt from business-related debt.

Several district courts have held that instituting foreclosure proceedings is not debt collection under the FDCPA. Bergs v. Hoover, Bax & Slovacek, L.L.P., 2003 WestLaw 22255679 (U.S.D.C. N.D. Tex. 2003); Hulse v. Ocwen Federal Bank, 195 F.Supp.2d 1188 (U.S.D.C. Ore. 2002). Also, see: Heinemann v. Jim Walter homes, Inc., 47 F.Supp.2d 716 (U.S.D.C. W.Va. 1998), aff'd, 173 F.3d 850 (4th Cir. 1999).
