Consumer brought claim against debt collector alleging violations of both the Fair Debt Collection Practices Act (FDCPA) and its North Carolina counterpart. On debt collector's motion to dismiss, the District Court, McKnight, United States Magistrate Judge, held that consumer's allegations that debt collector communicated with his neighbors in relation to his debt, and that the communication was not for the purpose of obtaining location information, were sufficient to state claims under both FDCPA and state debt collection statute.
Motion denied.
