LEGAL ACTION BY DEBT COLLECTORS -- VENUE

A debt collector may bring an action to enforce an interest in real property only where it is located. 15 U.S.C. 1692i(a)(1). This includes attorneys whose collection activities are limited to purely legal activities, such as the filing of collection actions or mortgage foreclosures. Fox v. Citicorp Credit Service, Inc., 15 F.3d 1507 (9th Cir. 1994); Scott v. Jones, 964 F.2d 314 (4th Cir. 1992); Shapiro and Meinhold v. Zartman, 823 P.2d 120 (Colo. 1992); Hester v. Graham, Bright & Smith, 2005 WestLaw 994704 (U.S.D.C. E.D. Tex. 2005); Martinez v. Albuquerque Collection Services, 867 F.Supp. 1495 (U.S.D.C. N.M. 1994); Dutton V. Wolhar, 809 F.Supp. 1130 (U.S.D.C. Del. 1992).
